Barack Obama - the unconstrained vision?
I don't like the sound of this...
I found this in an article by Peter Robinson at Forbes.com:
"Whereas McCain has promised to nominate justices 'who have a history of strict adherence to the constitution,' Obama has said instead that if 'someone is being treated unfairly, then the Court has to stand up if nobody else will, and that is the kind of judge I want.'
Justices would be called upon to consult not constitutional precedent but their own conceptions of fairness. 'Only once you got into the courtroom, in front of the judge,' Sowell says, 'would you finally learn what the law was. You would have no clue beforehand.' We would become less and less a nation of laws, more and more a nation ruled by nine men and women in robes."
